Pursuant to an Order of Court dated October 7, 2011 in the above captioned partition action, notice is given that the following described real property will be offered for public sale by the below signed Master-in-Equity at the Kershaw County Courthouse on December 5, 2011 at 12:00 noon to the highest bidder, subject to confirmation by the Kershaw County Court of Common Pleas in the form of an order confirming sale The sale is subject to current 2011 taxes, covenants, conditions, restrictions, reservations, rights rights of way and easements of record Any encumbrances of record are to be satisfied out of the purchase price. The property will be sold on the following terms a 5% deposit of the purchase price must be made to the Master-in-Equity at the time of the bid, the balance of the purchase price must be delivered to the Master-in-Equity not later than 30 days from the date of the bid, the deposit will be forfeited if the full purchase price is not timely delivered to the Master-in-Equity.

The property will be sold in its present Aas is, where is, with all faults @ condition, without any warranty, express or implied. Title will be transferred and delivered by a Master-in-Equity deed, containing no warranty of title. The property to be sold is comprised of 6 contiguous parcels, containing 131 acres, more or less, having a physical street address of 888 White Pond Road, Elgin, SC, and taxed by Kershaw County as tax map numbers 349-00-00-033 and 034. THe parcels are described as follows

Parcel No. 1, All that piece, parcel or tract of land in the County of Kershaw, State of South Carolina, lying about three (3) miles southwest of the village of Blaney (now Elgin), containing Forty (40) acres and being designated as Block No. 1 on that plat prepared for Weston Cook by A. B. Boykin, Surveyor, dated June 9, 1953. Said tract of land is bounded as follows Northeast by property now or formerly of Henry Savage, Southeast and South by Block No 2 on said plat, now or formerly of West Cook and by property now or formerly of Paul Kirkland, Southwest and West by property now or formerly of Paul Kirkland, property now or formerly of J L Kirkland and property now or formerly of Goff.

Also, A right of way Twenty-five (25) feet in width across the land of Paul Kirkland, said right of way to run along the line between the land of Paul Kirkland and the lands now or formerly of J. L. Kirkland, said right of way having been acquired by Weston Cook under deed of Henry Savage, Jr recorded in said Register of Deeds Office in Deed Book DQ at Page 539.

Parcel No. 2 All that piece, parcel or tract of land, situate, lying and being in School District No 12, Wateree Township, Kershaw County, South Carolina , about two and one-half (22 ) miles south of Blaney, (now Elgin) on State Highway leading from Blaney to U. S. Highway No. 601, containing Fifty (50) acres, more or less, and being bounded as follows North by property now or formerly of Ira Goff; East by property now or formerly of Paul Kirkland, South by State Highway leading from Blaney to U. S. Highway No. 601; and West by property now or formerly of Goff and Kirkland

Parcel No. 3 All that piece, Parcel or tract of land in the County of Kershaw, State of South Carolina, lying about three (3) miles southwest of the Village of Blaney (Now Elgin), containing 179 acres, more or less, and being designated as Tract No. 2 on plat prepared for Weston Cook by A. B. Boykin, Surveyor, dated June 9, 1953, and being the southeastern and remaining portion of a larger tract show on plat prepared by A. B Boykin, Surveyor, dated March 2, 1944, recorded in Plat Book 11 at Page 53, said property is bounded as follows Northeast by lands now or formerly of Savage; South by lands now or formerly of Kirkland, West and Northwest by lands now or formerly of Weston Cook.

Parcel No. 4 All that piece, parcel or tract of land, lying and being situate three (3) miles southwest of Elgin, in Kershaw County, South Carolina containing approximately Twenty-five (25) acres, more or less, being shown and designated as the Smith Tract No. 4 on a plat by S. Tetterton, dated April 24, 1964, recorded in the Office of the Register of Deeds for Kershaw County, said property being bounded as follows North by property now or formerly of Goff, East, South, and West by property now or formerly of Ed. L. Smith Construction Company, Inc.

Parcel No. 5 All that piece, parcel or tract of land situate, lying and being in School District No 12, Wateree Township, Kershaw County, South Carolina, containing Two (2) acres, more or less, and being a strip of land Fifty (50) feet in width extending along the boundary of property now or formerly of Paul Kirkland from the paved highway leading from Blaney (now Elgin) to S. C. Highway No. 12 in an easterly direction to property now or formerly of S. Alvin Creed; said strip of land is bounded North by property of S. Alvin Creed, West by said paved road for a distance of fifty (50) feet, South by property now or formerly of Paul Kirkland, and West by Property now or formerly of S. Alvin Creed.

Parcel 1 through 5 as described above being the same property conveyed to Smyrl Alvin Creed by deed of Nellie W. Creed dated March 15, 2000, and recorded in the Office of the Register of Deeds for Kershaw County on April 5, 2000, in Book 860 at page 17.

Parcel No. 6 All that piece, parcel or tract of land, situate, lying and being in the State of South Carolina, County of Kershaw, near Elgin, containing 872 acres, and being bounded North by property now or formerly of G. A. Goff; East by property now or formerly of Creed; and West by property now or formerly of Ed. L. Smith and being more particularly shown on that plat prepared for G. A. Goff by E. W Ramer Company, RLS dated June 12, 1975, recorded in the Office of the Register of Deeds for Kershaw County in Plat Book 36, at page 1848.

Parcel 6 being the same property conveyed to S. Alvin Creed by deed of Betty Ruth B. Senn dated November 23, 1988, and recorded in the Office of the Register of Deeds for Kershaw County on November 24, 1998, in Book 701 at page 97.

The property to be sold includes an approximately 9 acre man-made pond, which predates all land purchases, a single-family residence containing approximately 1,870 square feet, a concrete block recreation building containing approximately 1,178 square feet, and two barns containing approximately 1,650 and 1,600 square feet.
